Terms of service
1. General terms
1.1 The present sale terms (hereinafter, “Sale Terms”) regulate the agreement between the company Kids Fashion OÜ and the customer (“Customer”) formalised through the website www.brums.ee (the “Website”) for purchasing the products from Kids Fashion OÜ via the Website.
1.2 Kids Fashion OÜ may change the Sale Terms at any time, without prior notice to the Customer. However, Kids Fashion OÜ will announce such changes on the Website. Also, once the Customer has received confirmation of receipt from Kids Fashion OÜ of his/her order, the Sale Terms applicable to that order will not be changed.
1.3 The prices shown on the Website are subject to change. Kids Fashion OÜ reserves the right to change prices without prior notice. However, once the confirmation of receipt of an order is received from Kids Fashion OÜ, the price payable in respect of that order will not be changed.
2. Price and Payment
2.1 The prices and offers presented on the Website are given in Euros.
2.2 The prices and offers presented on the Website include Value-Added Tax (“VAT”) and are valid only for orders placed on-line through the Website.
2.3 The prices shown on the Website are subject to change. Kids Fashion OÜ reserves the right to change prices without prior notice.
3. Method of Payment
3.1 To pay for the order the Customer may use credit card. We also accept bank transfers.
4. Delivery
4.1 Our delivery time starts from the moment an order is accepted and includes a period where your items will be processed and dispatched by our warehouse.
4.2 Processing of your order will begin after payment is received. We will provide you with an estimated delivery date in your dispatch notification email and aim to inform you should there be any changes.
4.3 Make sure that the shipping address is correct as Kids Fashion OÜ unable to redirect orders once they are on their way to you.
4.4 The Customer must verify the state of the packaging upon delivery. If the package is damaged, the Customer must not accept the delivery and should inform Kids Fashion OÜ on the matter through the e-mail (tallinn@brums.ee).
5. Return of Products for Any Reason (Right of Withdrawal)
5.1 If the Customer is not satisfied for any reason with the products purchased, he/she will have 14 calendar days from the delivery date to return the product. The Customer may return the purchased product, provided that the product has not been used in any way.
5.2 The product must be returned and the Customer must assume the expenses of this return.
5.3 The products are to be returned with their original packaging and labelling, together with the applicable Returns Note sent to tallinn@brums.ee indicating the name and surname of the Customer, bank account details, the article Customer wants to return and specifying why.
5.4 Upon satisfactory inspection of the returned goods, Kids Fashion OÜ will refund the price of the product within thirty (30) days of receiving the order cancellation and product return notification from the Customer. The delivery expenses are never refunded (except in case of incorrect or defective items); the customer will also have to pay for the return expenses.
5.5 The refund will be made in the same manner as the original payment.
5.6 Kids Fashion OÜ will not make the refund until receiving the returned product and verifying the condition of the product in the warehouse; once the condition of the returned product has been verified, the Customer will be refunded the relevant amount.
6. Return of Defective Products
6.1 The Customer has the right to return defective products.
6.2 The Customer should sent the Deffect Note to tallinn@brums.ee indicating the name and surname of the Customer, bank account details, the article Customer wants to return and specifying the deffect.
6.3 Kids Fashion OÜ is obliged to replay to the Client’s Deffect Note within forteen (14) days of receiving the Client’s Note.
6.4 If the Customer returns a product because it is defective and the return is approved, Kids Fashion OÜ will refund the value of the product and the delivery expenses, as well as the direct costs involved in the return.
7. Events Outside our Control
7.1 We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under a Contract that is caused by events outside our reasonable control (Force Majeure Event).
8. Other Terms and Conditions
8.1 The Customers are informed that their personal data will be included in files under the ownership of Kids Fashion OÜ for commercial purposes, customer relation management advertising and commercial prospecting, including the sending (through post, e-mail, or other electronic means) of commercial messages concerning products, services, offers, promotions, and news concerning the Kids Fashion OÜ.
8.2 We will not sell, distribute or lease your personal information to third parties unless we are required by law to do so.
8.3 Kids Fashion OÜ will put in place and maintain technical and organisational security measures which are appropriate and sufficient to prevent any processing of personal data in breach of: (a) these Sale Terms or applicable data protection laws; and (b) any accidental loss, destruction, or damage of personal data.
8.4 Purchases made through the tallinn@brums.ee and under these Sale Terms are subject to Estonian law.
8.5 Any dispute or discrepancy arising from the application or interpretation of these Sale Terms, as well as the contracts incorporating them, shall be subject to the non-exclusive jurisdiction of the courts of Estonia.
